Ord. No. 2020-6. Open Container & Outdoor Dining In Public Right of Way – Amendment.
Amending Section 10.04.080, "Drinking – Public Areas," of Title 10, "Peace, Safety and Morals," of the San Mateo Municipal Code
WHEREAS, Section 10.04.080 currently makes it unlawful for any person to drink or possess any open container of an alcoholic beverage in a public place; and
WHEREAS, the City Council wishes to enable restaurants to offer outdoor dining on portions of public right-of-way; and
WHEREAS, the City Council wishes to enable restaurants offering outdoor dining to provide alcoholic beverages to customers;
NOW, THEREFORE, THE COUNCIL OF THE CITY OF SAN MATEO ORDAINS AS FOLLOWS:
Section 1.
Section 10.04.080, "Drinking – Public Areas," of Chapter 10.04, "Public Peace and Order" of the San Mateo Municipal Code is amended to read:
10.04.080 – Drinking – Public Areas.
It is unlawful for any person to drink or possess any open container of beer, wine, or other intoxicating beverage on any public sidewalk, alley, street, or highway, unless expressly permitted at that location pursuant to a permit, such as an outdoor dining permit or special event permit, and the consumption is in conformance with the terms of the permit.
Section 2. Environmental Determination.
In accordance with California Environmental Quality Act (CEQA) Guidelines Section 15378, adoption of this Ordinance is not a project subject to CEQA because it can be seen with certainty that amending the City's open container ordinance will not impact the environment.
Section 3. Severability.
In the event any section, clause or provision of this ordinance shall be determined invalid or unconstitutional, such section, clause or provision shall be deemed severable and all other sections or portions hereof shall remain in full force and effect.
Section 4. Publication.
This Ordinance shall be published in summary in a newspaper of general circulation, posted in the City Clerk's Office, and posted on the City's website, all in accord with Section 2.15 of the City Charter.
Section 5. Legislative History and Effective Date.
This ordinance was introduced on June 1, 2020, and adopted on June 15, 2020, and shall be effective 30 days after its adoption.
