27.62.090 MAINTENANCE AND UTILITIES.

(1) For each area to be held under common ownership, a document showing the future maintenance provisions shall be submitted for review with the application. Such provisions shall include mandatory membership of all property owners in any association designed for maintenance of the open space.

(2) Where local open spaces are to be conveyed to the City in fee, the developer shall convey them at the stage and in the condition agreed upon in connection with processing and approval of the application.

(3) In the event that the application results in a subdivision map showing lands available for park, recreation, open space, or other municipal purposes, the City Council, as a condition of approval of the application, may establish such conditions on the ownership, improvement, use, and maintenance of such lands as it deems necessary to assure the preservation of such lands for their intended purpose.
